INDEPENDENT MEDIA COMMISSION HELD A REGULAR MEETING

The Independent Media Commission (IMC) on June 17, 2019, under the chairmanship of the Chairman of the IMC, Mr. Muja FERATI, held its seventh regular meeting for 2019.

Initially the Committee approved the agenda of the meeting and then the minutes from the last meeting.

During the meeting, the IMC Commission has handled several requests in licensing cases, respectively requests for licensing of AMSPs through the distribution operator, for license renewal, for change of ownership and program scheme, for license termination, for changing the program scheme as well as for rejecting the request for license transfer.

Licensing cases are listed as below:

Tv Malisheva – recommendation for licensing of AMSP by broadcasting through the distribution operator;

Radio Voice of Pozheran – recommendation for license termination;

Zico Tv – recommendation to change the program scheme;

Etv – recommendation for license renewal;

Swiss Plus 1 – recommendation for licensing of distribution operator;

Radio Aktiv – recommendation for change of ownership and program scheme;

Radio Llapi – recommendation to reject the request for license transfer;

In relation to media monitoring during the election campaign, the Commission also reviewed the Monitoring Report of the AMSPs during the election campaign during the re-voting process in the municipalities of North Mitrovica, Zubin Potok, Zvecan and Leposavic. It is estimated that the media that covered this campaign acted in accordance with applicable law.

During the meeting, the Commission reviewed a public letter from the Kosovo Chamber of Commerce regarding the Regulation on the Distribution of Audio and Audiovisual Media Service Providers in IMC-2016/1. Upon reviewing this request, the Commission finds as grounded the request of the Kosovo Chamber of Commerce through which it highlights the unequal and discriminatory position of audiovisual media service providers in relation to distribution operators. The Commission decided that audiovisual media service providers who do not broadcast over the terrestrial network are exempted from the mandatory transfer list. Audiovisual media service providers with terrestrial (frequency) transmission remain part of the mandatory transmission. This Decision shall remain in force until another decision of the IMC is rendered on this matter.

The Commission has in addition reviewed a public letter from Kosovar Roma civil society representatives, journalists, students and intellectuals on the recent attacks on members of the Kosovo Roma community.

The IMC is seriously following the latest developments regarding media reports of attacks on members of the Roma community in Kosovo. Media monitoring of these reports has been carried out and in case of possible violations, the IMC will take legal measures in accordance with applicable law, in order to ensure full compliance with the Law and bylaws of the IMC.
