The Independent Media Commission (IMC) on January 28, 2021, under the chairmanship of the Chairman of the IMC Mr. Xhevat LATIFI, held its first regular meeting for 2021. After the approval of the meeting agenda, the minutes of the last meeting were also approved.

According to the agenda of the meeting, the Commission initially reviewed several legal cases related to violations of IMC legislation, namely violations of the Code of Ethics for Audiovisual Media Service Providers and Regulation IMC-2020/01 on the Distribution of Audiovisual Media Service Providers. The IMC Commission reviewed the following legal cases:

Kujtesa Net vs Klan Kosova - after reviewing this case the Commission concluded that OSHMA Klan Kosova did not act in violation of Article 10, paragraph 1 and 2 of Regulation IMC-2020/01. Therefore, the Commission decided that the complaint of the operator Kujtesa Net be rejected as ungrounded.

Telkos vs Klan Kosova - after reviewing this case the Commission concluded that OSHMA Klan Kosova did not act in violation of Article 10, paragraph 1 and 2 of Regulation IMC-2020/01. Therefore, the Commission decided that the complaint of the operator Telkos be rejected as ungrounded.

Shell vs Radio Kosova1 and Glam Radio - after reviewing this case the Commission concluded that OSHMA Radio Kosova 1 and Glam Radio have acted in accordance with Article 6, paragraph 5 of Regulation IMC-2017/07. The Commission therefore decided that Shell's complaint should be rejected as unfounded.

Orange Net vs Klan Kosova - after reviewing this case the Commission came to the conclusion that Klan Kosova acted in violation of the Code of Ethics KKPM-2016/03. The Commission decided to sanction the Media Klan Kosova with Remarks in accordance with Article 30, paragraph 1, of the IMC Law, for violation of Article 6, paragraph 1, of the Code of Ethics KKPM 2016/03 for Media Service Providers in Republic of Kosovo.

Fiber Link vs Klan Kosova - after reviewing this case the Commission came to the conclusion that OSHMA Klan Kosova did not act in violation of Article 10, paragraph 1 and 2 of Regulation IMC-2020/01. The Commission therefore decided that the complaint of the Fiberlink operator should be rejected as ungrounded.

Kadria Net vs Klan Kosova - after reviewing this case the Commission concluded that OSHMA Klan Kosova did not act in violation of Article 10, paragraph 1 and 2 of Regulation IMC-2020/01. The Commission therefore decided that the complaint of the operator Kadria Net be rejected as ungrounded.

Devolli Grup against RTK1 - after reviewing this case the Commission concluded that RTK 1 has acted in violation of the Code of Ethics KKPM-2016/03. The Commission decided that RTK 1 should be sanctioned with a Reprimand in accordance with Article 30, paragraph 1, of the IMC Law.

Following the meeting, the Commission addressed several requests in the licensing cases, which related to the licensing of the audiovisual media service provider (OSHMA) with broadcasting through the network of OSHs, a request for change of ownership and name and a request for termination. of the decision for licensing of the Distribution Operator

The licensed cases reviewed are listed as follows:

Klina TV - Decision for issuing a license for media service providers with broadcasting through the network of OSHs;

Radio Drenica - Decision for change of ownership and name;

Advan Tech Shpk - Decision for termination of the decision for licensing of the Distribution Operator.

After reviewing the recommendations of the Executive Office for each of the licensing cases, the Commission concluded that all applications met the legal criteria of the IMC and decided to approve all recommendations.

According to the agenda, the Commission reviewed the Quarterly Work Report of the IMC, for the period October-December 2020. After the review, the Commission approved the Quarterly Report, which based on the legal obligation arising from Article 15 of Law no. 04 / L-44 on the Independent Media Commission, forwarded to the Assembly of the Republic of Kosovo.

Also regarding the work of the IMC on the preparations for monitoring the extraordinary elections for the Assembly of the Republic of Kosovo, which will be held on February 14, 2021, the Commission has reviewed the amendment to the IMC Guideline on the conduct of the Media during the elections. After review, the Commission approved the amended Guideline.
